What are the Terms of Use for Equifax?

THIS EQUIFAX ALLOW ACCESS UNLOCK OR TEMPORARY SECURITY FREEZE LIFT AGREEMENT AND TERMS OF USE ("AGREEMENT") CONTAINS THE TERMS AND CONDITIONS UPON WHICH YOU MAY REQUEST THAT EQUIFAX INFORMATION SERVICES LLC (“EQUIFAX”), THROUGH WWW.EQUIFAX.COM AND ALL OTHER WEBSITES OR WEBPAGES OWNED AND OPERATED BY EQUIFAX AND ITS AFFILIATES ("SITE") UNLESS OTHERWISE NOTED, TEMPORARILY LIFT A SECURITY FREEZE ON YOUR CREDIT REPORT OR UNLOCK YOUR EQUIFAX CREDIT REPORT IF YOU HAVE “LOCKED” YOUR EQUIFAX CREDIT REPORT USING A FEATURE OF A PRODUCT OFFERED BY AND OBTAINED FROM EQUIFAX CONSUMER SERVICES LLC (“ECS”) OR OTHER SERVICE PROVIDERS THAT MAY ENABLE YOU TO LOCK YOUR EQUIFAX CREDIT REPORT (A “PRODUCT”). YOU MUST ACCEPT THE TERMS OF THIS AGREEMENT TO PROCEED TO REQUEST THE UNLOCK OR TEMPORARY LIFT OF SECURITY FREEZE THROUGH THIS SITE. BY PROCEEDING, YOU ARE ACKNOWLEDGING ELECTRONIC RECEIPT OF, AND YOUR AGREEMENT TO BE BOUND BY, THIS AGREEMENT.

  1. PROVIDERS OF THE SERVICE. You are using the Site to take certain actions related to your Equifax credit report (“Equifax Credit Report”), specifically, temporarily lifting or permanently removing a security freeze on your Equifax Credit Report or “unlocking” your Equifax Credit Report by removing a “lock” placed through a Product (either being the “Service”). Equifax may use service providers, including affiliated companies and their service providers, to help Equifax perform these actions and fulfill related functions. Equifax and its respective service providers are collectively referred to in this Agreement as "We," "Us," and "Our." You, the person visiting and utilizing this Site, is referred to as "You" or "Your".
  2. PERSONAL INFORMATION; AUTHORIZATION. As needed to provide the Service to You, You authorize and instruct Us to access and use Your: (i) credit file with Equifax; (ii) "non-public personal information", "personal information", and/or "highly restricted personal information" about or concerning You as defined by the Gramm-Leach-Bliley Act (15 U.S.C. sec 6801 et seq); and (iii) other personal information. You acknowledge and agree that Your access to the Service via the Site is subject to Your prior written authorization and Our verification of Your identity. You hereby authorize Us to access Your personal credit file in order to provide the Service. For more information, you may review Equifax’s Privacy Statement and FCRA Summary of Rights page.
  3. IDENTITY VERIFICATION - AUTHORIZATION TO SHARE INFORMATION. To proceed with the Services through the Site, You must complete the identity verification process. We may use information from third-party sources, including your mobile carrier, to verify your identity. You authorize your wireless carrier to disclose information about your account, such as subscriber status, payment method and device details, if available, to support identity verification, fraud avoidance and other uses in support of the Service. This information may also be shared with other companies to support your use of the Service and for identity verification and fraud avoidance purposes. You proceed with the Service through this Site only on behalf of Yourself (unless otherwise noted) and by doing so, You acknowledge and agree that it is illegal to order credit information about anyone else. By proceeding and requesting the Services, You further certify that You are eighteen (18) years or older and that all of the information provided incident to Your request for the Service is true, accurate, complete and up to date.
  4. UNLOCKING YOUR EQUIFAX CREDIT REPORT. “Unlocking” Your Equifax Credit Report or lifting a security freeze on Your Equifax Credit Report allows creditors and other third parties with a permissible purpose under the Fair Credit Reporting Act, 15 U.C.S. § 1681, et seq., (“FCRA”) to lawfully obtain Your Equifax Credit Report. A lock on Your Equifax Credit Report is not the same as a security freeze. The FCRA provides for the ability to place, remove, and temporarily lift a security freeze on Your consumer credit report with nationwide consumer reporting agencies like Equifax. Locking or unlocking your Equifax Credit Report is a feature of a Product provided to you by ECS or another service provider offering such a feature. If You have locked Your Equifax Credit Report through a Product, You are requesting, through the Site, that Equifax “unlock” Your Equifax Credit Report. Once your Equifax Credit Report is unlocked, it will be locked again only if and when You take action to lock it through Your Product. If you have a Product with a lock feature, You may elect to place a security freeze rather than re-locking Your Equifax Credit Report.   5. TEMPORARY LIFT OF SECURITY FREEZE. Lifting or removing a security freeze on Your Equifax Credit Report allows creditors and other third parties with a permissible purpose under the FCRA to lawfully obtain Your Equifax Credit Report. The FCRA provides for the ability to place, remove, and temporarily lift a security freeze on Your consumer credit report with nationwide consumer reporting agencies like Equifax. If you have a security freeze on Your Equifax Credit Report, You are requesting, through the Site, that Equifax remove or temporarily lift that security freeze. A security freeze will be temporarily lifted for the time specified by You through the Site, and You do not need to take further action for the security freeze to be effective upon the end-date of the temporary lift.   6. CONSUMER CARE. If you have questions about Your Equifax Credit Report or the Service, you can contact the Customer Care team at 888-378-4329. Consumer Care is available 9:00 am to 9:00 pm (ET), Monday through Friday, and 9:00 am to 6:00 pm (ET), Saturday and Sunday or as otherwise posted at www.equifax.com/personal/contact-us/.
  7. AVAILABILITY. The Service may not be available to You through the Site based on age or other eligibility criteria or factors, including identity verification criteria. In the event requesting the Service through the Site is not available to You or the Service cannot be completed through the Site, You will be notified during the course of attempting to complete Your request for the Service and Your request will not be accepted. If You cannot complete your request for the Service through the Site, You may take action related to a security freeze or, if you have an applicable Product, lock on your Equifax Credit Report by phone or mail. Additional information is available in Section 8.
  8. OTHER SERVICE OPTIONS. If You cannot complete the Services on the Site or You simply do not wish to complete the Services using the Site, you may take the same actions related to a security freeze or lock (if you have a Product) online through myEquifax.com* or by phone or mail:

    *If you have a lock through a Product offered by another service provider or vendor, you would use the options provided by that vendor for online use of the features of that Product.
  9. ELECTRONIC AND TELEPHONIC COMMUNICATIONS. To access the Site, You must have: a compatible internet browser; an email account and appropriate email software; a personal computer, operating system and connection to the internet, or in the case of any mobile features, a wireless device, software and connection to the internet capable of supporting the foregoing; and sufficient electronic storage capacity on Your computer's hard drive or other data storage unit. You further understand and agree that this Agreement will be entered into electronically, and that the following information ("Communications") will be provided by Us to You by electronic means: this Agreement; any initial notices provided in connection with the Service, including without limitation this privacy policy, and regulatory disclosures. In furtherance of the foregoing, You expressly consent to receive such Communications electronically, by notices posted on the Site and You agree that any requirement that a notice, disclosure, agreement, or other communication be sent to You by Us in writing is satisfied by such Communications. You also expressly consent and agree to be contacted by Us or anyone acting on Our behalf for non-telemarketing purposes at any telephone number You provide to Us or we obtain for you, including wireless telephone numbers, for purposes completing and providing the Service, including identity verification. You further agree that We may make this contact by using a predictive dialer or an automatic telephone dialing system, including sending text or mobile messages by such a system, and/or by using an artificial or prerecorded voice. You agree to notify Us promptly if a telephone number You provided to Us is no longer a number at which You may be reached (such as in the event of number reassignment or if you want to revoke your consent to be contacted by telephone). Please note that mobile messaging, text, and data rates may apply. You may request a paper copy of any legally required notice, withdraw Your consent to receive Communications electronically, or change Your email or postal address for receipt of Communications, by calling Our Customer Care Team at 888-836-6351.
  10. NO GUARANTEE OF AVAILABILITY. Because of the nature of Internet and online communications, this Site may not perform as intended despite Our efforts, those of Your Internet service provider, and You. We do not guarantee uninterrupted or error free operation of this Site. From time-to-time, technical issues may also result in the unavailability of or disruption of the Site. In addition, Your use of the Site that is excessive or in a manner not contemplated by this Agreement may also result in the Site not performing as intended despite Our efforts. We will use reasonable efforts to maintain operation of the Site. If there is a system error or other problem concerning Your use of the Site, You agree to promptly notify Us of the same. We will try to correct the error, but You will not be entitled to any money for any system error of any type.
  11. PRIVACY. By submitting Your request, You acknowledge that We may use and share Your personal information in accordance with this Privacy Statement as contemplated herein.
  12. OWNERSHIP. This Site contains copyrighted material and any information that You retrieve is copyrighted by its owner. You may not remove, alter or cover any copyright or other proprietary notices placed on this Site related materials acquired through this Site. We, collectively or individually, retain ownership of all intellectual property rights in the Site, including without limitation any information, materials, text, graphics, images, logos, site design, and the selection, assembly, and arrangement of the Site ("Content"). The Content may not be copied, distributed, displayed, modified, reproduced, performed, published or reverse engineered in whole or in part without Our prior written permission.
  13. NO WARRANTY. NEITHER WE, NOR ANY OF OUR DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, SUPPLIERS, LICENSORS, AFFILIATED COMPANIES, OR AFFILIATED CREDIT BUREAUS ("AFFILIATED PERSON(S)") WARRANT THE CORRECTNESS, COMPLETENESS, CURRENTNESS, OR ANY OTHER ASPECT OF THE SITE OR INFORMATION CONTAINED IN THE SITE IN ANY WAY. THE SITE IS PROVIDED "AS IS", AND NO WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IS MADE.
  14. TO THE EXTENT APPLICABLE LAW DISALLOWS ANY DISCLAIMERS OR LIMITATIONS IN THIS AGREEMENT, SUCH DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU.
  15. LIMITATION OF LIABILITY. NEITHER WE NOR ANY OF OUR AFFILIATED PERSONS WILL BE LIABLE TO YOU FOR ANY LOSS OR INJURY ARISING OUT OF OR CAUSED, IN WHOLE OR IN PART, BY ANY NEGLIGENT ACTS OR OMISSIONS OF ANY SUCH PERSON PROVIDING AUTHENTICATION SERVICES, OR IN DOING ANYTHING RELATED THERETO. NEITHER WE NOR THE AFFILIATED PERSONS WILL BE LIABLE TO YOU FOR DIRECT, SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EMOTIONAL DISTRESS DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS OR OPPORTUNITIES, BUSINESS INTERRUPTION AND LOSS OF PROGRAMS OR DATA) IN CONNECTION WITH YOUR USE OF THIS SITE, ANY USE OR RELIANCE UPON INFORMATION FOUND AT THIS SITE OR PROVIDED AT THIS SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
    THIS SECTION DOES NOT APPLY TO NEW JERSEY RESIDENTS.
  16. APPLICABLE LAW. This Agreement and its enforcement shall be governed by the laws of the state in which You most recently told Equifax You live according to Equifax’s records, without regard to conflict of law principles.
  17. ENTIRE AGREEMENT BETWEEN US. This Agreement constitutes the entire agreement between You and Us regarding the Service as requested through, and information contained on or acquired through, this Site or provided by Equifax, including through other linked third party Internet sites. In the event that this Agreement shall be translated into any language other than English, then the English language version of the Agreement shall control. This Site may contain hyperlinks or other references to third party Internet sites that Equifax does not own or operate. You may be subject to additional terms and conditions that apply when You use third party Internet sites. You agree that You are responsible for reviewing and understanding any terms and conditions governing any third party Internet site and products and Equifax has no responsibility therefore. This Agreement takes effect on Your first use of this Site, and it applies to all persons accessing the Site from Your computer, and to all persons using Your personal information to request the Service at the Site. The headings used in this Agreement are for convenience only and such headings are not to be used in determining the meaning or interpretation of these terms and conditions of use. You agree that this Agreement is not intended to and does not confer any rights on any persons other than Us and You and the third party beneficiaries referenced in this Section. If any provision of this Agreement is held invalid, unenforceable or void by applicable laws, the remaining portions shall continue in full force and effect. You may not assign this Agreement to someone else. Unless otherwise explicitly stated, the provisions contained in Sections 3 (Identity Verification), 12 (Ownership), 13 (No Warranty), 14 (Limitation of Liability), 15 (Applicable Law) and this Section 16 will survive termination of this Agreement and Your access to and use the Account and the information contained on this Site or provided by Us. Suppliers are third party beneficiaries under this Agreement.
